SUSPENSION
The DMV may impose a suspension, with or without a period of probation, when a driver fails to exercise a reasonable degree of care necessary to avoid causing or contributing to a collision.
The severity of the action will depend on the circumstances of the incident, the driver’s level of negligence, and any aggravating or mitigating factors.
Examples of driving conduct that may warrant suspension include:
- Committing a traffic violation that causes or contributes to a collision.
- Attempting to pass another vehicle on a winding roadway rather than slowing down or waiting for a safe passing area. Depending on the degree of disregard for traffic safety, this conduct may warrant revocation.
- Attempting to accelerate through a yellow traffic signal and striking a pedestrian in a crosswalk. This conduct may warrant revocation if the driver observed, or should have observed, the pedestrian before accelerating.
- Misjudging the speed or distance of an approaching vehicle while making a left turn, particularly when the driver has prior left-turn violations or a history of similar unsafe driving behavior.
